Snapitect Terms of Service

1. Acceptance of Terms

Welcome to Snapitect! These Terms of Service (the "Terms") constitute a legal agreement between you and Snapitect ("we," "us," or "the platform").

By using our service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Significant changes will be notified via email. Continued use of the service after modifications indicates acceptance of the new Terms.

2. Service Eligibility and Account

2.1 Age Requirements

You must be at least 13 years old to use this service
Users aged 13-17 require parental or legal guardian consent

2.2 Account Registration

Each person may register only one account
You must provide accurate and truthful registration information
Use of false identities or others' information is prohibited

2.3 Account Security

You are fully responsible for all activities under your account
Keep your login credentials secure and do not share them with others
Notify us immediately if you discover unauthorized account access

3. Service Plans and Credit System

3.1 Free Plan

70 credits (one-time grant)
Generates approximately 35 images
Testing purposes only, not for commercial use
Generated images include watermarks

3.2 Paid Plans

Choose the subscription plan that fits your needs:

3.3 Credit Rules

Each image costs 2 credits
Credits reset monthly (subscription-based)
Credits are non-transferable and non-refundable
Unused credits do not roll over to the next month

4. Payment and Refunds

4.1 Payment Methods

All payments are securely processed through Stripe
Accepts credit cards and debit cards
Subscriptions auto-renew, cancellable anytime

4.2 Refund Policy

Our refund policy is as follows:

Prorated based on credit usage
Formula: Refund Amount = Subscription Fee × (1 - Used Credits %)
Example: $69 plan with 50% credits used → $34.50 refund

Important Notes:

Refund requests must be submitted within the current billing cycle
Fraudulent refunds (e.g., chargebacks, scams) result in permanent account ban
Processing time: 5-10 business days

4.3 Cancellation

Cancel anytime in account settings
Access remains until end of current billing period
No charge for the following month

5. Intellectual Property and Content Ownership

5.1 Your Uploaded Images

Copyright Ownership:

You retain all rights to your uploaded images
You represent that you own or have authorization for uploaded content

License Granted: You grant Snapitect a non-exclusive, worldwide, royalty-free, transferable license to:

Store, process, and display your uploaded content
Provide AI image generation services
Improve and optimize platform functionality

5.2 AI-Generated Images

Free Users

Generated images are owned by Snapitect
You receive a CC BY-NC 4.0 license (Attribution-NonCommercial)
Not for commercial use
No resale
Personal testing and learning only

Paid Users (Basic/Pro/Business)

You own full rights to generated images
Commercial use permitted
Modify and edit freely
Use for marketing and advertising
Business plan includes resale rights
No attribution to Snapitect required

5.3 Platform Rights

Snapitect retains a perpetual, worldwide, royalty-free license to all user prompts, generation parameters, and outputs for:

Platform showcase and examples
Marketing and promotional materials
AI model improvement
Research and development

5.4 Copyright Disclaimer

Important Notice:

AI-generated images may resemble existing copyrighted works
Snapitect does not guarantee that generated content does not infringe third-party rights
You assume full legal responsibility for using generated images
Snapitect is not liable for any disputes arising from copyright infringement

6. Prohibited Uses

6.1 Account Abuse

Creating multiple accounts
Using false information for registration
Sharing accounts with others
Circumventing rate limits or technical protections

6.2 Prohibited Content

You may not use Snapitect to generate:

Illegal Content: Violates laws or regulations
Infringing Content: Unauthorized use of trademarks, copyrights, or likenesses
Violent Content: Gore, abuse, terror, war scenes
Adult Content: Pornography, nudity, sexual content
Hate Speech: Racial, gender, or religious discrimination
Misinformation: Deepfakes, misleading content

6.3 Technical Abuse

Reverse engineering, decompilation, or hacking
DDoS attacks, SQL injection, or malicious behavior
Unauthorized scraping or crawling

7. Service Suspension and Termination

7.1 We May Terminate Your Account

We reserve the right to suspend or terminate your service if:

You violate any provision of these Terms
You engage in fraudulent, abusive, or illegal behavior
Your account is inactive for more than 12 months
Required by law or regulation

7.2 Effects of Termination

Immediate loss of access
No refund for remaining credits
All data permanently deleted after 30 days

7.3 You May Anytime

Cancel subscription (access until end of billing period)
Delete account (in account settings)

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

Snapitect services are provided "as is" and "as available" without warranties of any kind, including but not limited to:

Uninterrupted or error-free service
Results meeting your expectations
Generated content not infringing third-party rights
Server availability

8.2 Limitation of Liability

To the maximum extent permitted by law:

Snapitect's maximum liability shall not exceed the fees you paid in the past 12 months
We are not liable for:
- Indirect damages or lost profits
- Data loss or business interruption
- Reputational harm

8.3 Third-Party Services

We use third-party services (e.g., Stripe, cloud storage) to provide functionality. We are not responsible for failures or errors of third-party services.

9. Dispute Resolution

9.1 Governing Law

These Terms are governed by the laws of the State of California, United States.

9.2 Dispute Resolution Process

Negotiation: First attempt friendly negotiation
Arbitration: If negotiation fails, submit to arbitration

9.3 Class Action Waiver

You agree to waive the right to participate in class action lawsuits. All disputes shall be resolved individually.

10. Miscellaneous

10.1 Entire Agreement

These Terms constitute the entire agreement between you and Snapitect, superseding all prior oral or written agreements.

10.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

10.3 No Waiver

Our failure to exercise or delay in exercising any right does not constitute a waiver of that right.
